Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 5A - RETURNS POLICY

While we're confident you'll love our Happy Tuesdays products, we understand that sometimes things might not be exactly what you expect. We want you to be completely satisfied with your shopping experience at happytuesdays.com. This policy outlines the conditions under which you can return items purchased on our website. 

Right of Withdrawal (EU): If you are a consumer based in the European Union, you have the right to withdraw from the purchase agreement for most items within 14 days of receipt of the goods, in accordance with the Consumer Contracts Regulations. This is a "cooling-off" period that allows you to change your mind about the purchase.

Happy Tuesdays Return Policy: We offer a generous return policy that goes beyond the minimum legal requirements for first purchases.

• First Purchase: For your first ever purchase from happytuesdays.com, if you haven’t made use of your order, you can return it, having used no more than 2 sachets of product from your order, within 30 days of receipt for a full refund (excluding original delivery costs).

• Subsequent Purchase/s: For your subsequent purchase/s from happytuesdays.com, if you haven’t made use of your order, you can return it, having used no product from your order, within 14 days of receipt for a full refund (excluding original delivery costs).

Please note: orders made with a referral discount code are not eligible for our first purchase 30 day return policy.

Please note the following exceptions:

• Hygiene Reasons: For hygiene reasons, we cannot accept returns of earplugs once they have been opened.

• Items Purchased Elsewhere: If you purchased an item from another retailer, you will need to follow their return policy.

How to Make a Return: To initiate a return, please contact our customer service team by email at help@happytuesdays.com within the relevant return period (30 days for first purchase, 14 days for subsequent purchases). We will provide you with instructions on how to return the item.

Return Conditions: All returned items must be unopened and in their original packaging.

Return Costs: You will be responsible for the cost of returning the items to us, unless the return is due to a mistake on our part (e.g., incorrect item sent).

Refunds: Once we receive your returned item and confirm it meets the return conditions, we will issue a full refund (excluding original delivery costs) within 14 days using the same payment method you used for the original purchase.

Please note: This extended 30 day guarantee applies to first-time customers only. Standard returns policy applies to subsequent orders.

We reserve the right to refuse returns that do not meet our return policy.

Changes to this Policy: We may update this Returns Policy from time to time. The latest version of the policy will be available on our website.

SECTION 5B - SUBSCRIPTIONS
Your subscription will automatically renew at the end of each billing period (e.g. monthly) unless you cancel it before the renewal date. You can easily cancel your subscription at any time by logging into your account on our website or by contacting our customer support team at help@happytuesdays.com. We will send you a reminder email before each renewal period so you have the option to cancel then. If you cancel your subscription, you will not be charged for any future subscription periods.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

By consenting to Happy Tuesdays SMS marketing in the checkout and initialising a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase.

If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 21 - DELIVERY
Delivery Estimates: We provide estimated delivery timelines at checkout which are averages based on historical data provided by our delivery partners. These are provided as a guideline and are not a guarantee. Delays can occur due to unforeseen circumstances beyond our control, such as carrier issues, customs clearance, or inclement weather. Time is not of the essence of the contract between Happy Tuesdays and our customers.

Delivery Service: You are purchasing a delivery service, and the estimated timelines are a reflection of the chosen service's usual performance. We are not liable for delays caused by the chosen carrier.

Tracking Information: Upon shipment, you will receive a notification with tracking information to follow your order's progress.

Delivery Address: We will ship your order to the address provided at checkout. Please carefully review your address for accuracy before submitting, as we cannot be held liable for delays or non-delivery due to incorrect information entered by the customer.

Incorrect Address: In the event that a package is returned to us due to an incorrect or incomplete address, a replacement order can be arranged, however, additional shipping charges may apply.

Shipping terms: For international and wholesale orders outside the UK and EU, Delivery at Place (DAP) shipping terms apply. While we generally don’t ship anywhere that extra customs fees should apply, the buyer assumes responsibility for all import procedures, including customs clearance, import duties, and taxes, as well as the final delivery to their designated address.

General: We will use commercially reasonable efforts to accommodate your requests related to order changes or cancellations. To ensure your order accuracy, please review all information carefully before submitting. We aim to respond to order enquiries within 48 hours; this response time is a best effort and may vary depending on enquiry volume.
